App Store End User License Agreement

For RETUOR downloaded through the Apple App Store, the Apple Standard End User License Agreement (EULA) applies to your license to the app. The RETUOR Terms of Service below describe use of our service. Read our Privacy Policy for information about your data.

Premium Rider subscriptions

Premium Rider provides the paid features described in the purchase screen for the price and billing period displayed before confirmation. App Store subscriptions are billed monthly. Website subscriptions offer the billing periods displayed at checkout.

For App Store purchases, payment is charged to your Apple Account at confirmation. Subscriptions automatically renew unless canceled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the current period ends at the applicable subscription price. Manage or cancel in your App Store account settings or Apple's subscription management page. Use Restore Purchases in the app to restore an eligible App Store subscription.

For website purchases, manage or cancel through your membership settings or the membership cancellation page. Cancellation stops future renewals; access continues through the paid period. Deleting the app does not cancel a subscription. App Store subscriptions must be canceled through Apple.

RETUOR Terms of Service

Effective August 5, 2026

1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of RETUOR, including its mobile applications, websites, maps, navigation, location features, clubs, events, rides, routes, games, messaging, content, subscriptions, and related services (collectively, the “Service”). “RETUOR,” “Mackes Software,” “we,” “us,” and “our” include RETUOR, Mackes Software, and their respective owners, members, officers, directors, employees, contractors, agents, licensors, service providers, parents, subsidiaries, affiliates, successors, assigns, sponsors, partners, and any entity or person having any business, contractual, operational, promotional, or other relationship with RETUOR or Mackes Software (collectively, the “Released Parties”). By creating an account, accessing, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be legally capable of agreeing to these Terms and meet the minimum age required by applicable law. You are responsible for the accuracy of your information, safeguarding your login credentials, and every activity performed through your account. You may not impersonate another person, create an account for someone without authority, share access in a way that compromises security, or use the Service after suspension or termination. Notify us promptly of suspected unauthorized use.

3. Entertainment and informational purposes only

RETUOR is provided for entertainment, social, planning, and general informational purposes only. It is not a safety system, emergency service, traffic-control service, law-enforcement service, weather service, professional navigation service, legal service, medical service, or substitute for training, licensing, insurance, sound judgment, official notices, posted signs, or real-world conditions. Points, achievements, leaderboards, challenges, routes, recommendations, and other app features have no cash value unless expressly stated and must never be treated as instructions to take a risk.

4. Ride at your own risk; assumption of risk

Motorcycling, driving, boating, operating ATVs or other vehicles, traveling on public or private roads or trails, attending events, meeting other users, and participating in games or challenges are inherently dangerous and may result in property damage, injury, permanent disability, or death. Risks include traffic, collisions, loss of control, mechanical failure, road defects, gravel, debris, construction, animals, obstacles, water, terrain, visibility, rider skill, fatigue, distraction, criminal activity, acts of other people, and changing weather. You knowingly and voluntarily assume all risks associated with your activities, whether known or unknown, foreseeable or unforeseeable, and whether or not information from the Service contributed to your decision.

5. Your responsibility and safe operation

You alone are responsible for your conduct, route choices, vehicle, passengers, protective equipment, licensing, registration, insurance, physical condition, training, speed, and compliance with laws. Always observe the road, trail, waterway, weather, traffic, signs, closures, restrictions, and instructions from authorities. Do not interact with the Service while operating a vehicle when doing so would be unsafe or unlawful. Stop in a safe and legal place before using controls. Never follow a route or instruction that appears unsafe, illegal, closed, inaccessible, or inconsistent with actual conditions.

6. No promotion of illegal or dangerous activity

RETUOR does not promote, authorize, encourage, or condone speeding, racing on public roads, reckless driving, stunts in unauthorized areas, trespass, impaired operation, distracted operation, evading law enforcement, harassment, violence, theft, vandalism, or any other illegal or dangerous activity. You may not use the Service to plan, coordinate, advertise, record, reward, or facilitate unlawful conduct. Game rules, points, achievements, time records, and leaderboards never override the law or safety.

7. Maps, routes, navigation, location, road, and weather data

Maps, pins, routes, distances, travel times, speed, location, tracking, weather, road information, and directions may be delayed, incomplete, unavailable, or inaccurate. Roads, trails, bridges, waterways, businesses, fuel, event locations, and access rights may change without notice. Weather can change rapidly. GPS and network signals can fail. The Service does not guarantee that any route is legal, public, open, passable, appropriate for your vehicle, or safe. You must independently verify conditions and obey official sources and real-world information. The Released Parties are not responsible for road, trail, water, traffic, construction, weather, environmental, or other conditions.

8. Users, rides, events, clubs, games, and meetups

Users act independently and are not employees, agents, representatives, or partners of the Released Parties. We do not control or guarantee any user’s identity, statements, skill, fitness, vehicle, insurance, background, conduct, route, event, club, game, payment, or compliance with law. Hosts and club organizers are solely responsible for their activities, rules, permissions, safety planning, and participants. You are responsible for deciding whether, where, when, and with whom to ride, meet, communicate, transact, or participate. Use caution when meeting people and report emergencies to the appropriate authorities.

9. Backpackers passenger matching and user interactions

Backpackers is an optional communication and discovery feature that allows independent users to indicate that they are looking for a passenger ride, willing to offer a passenger ride, or both. It is not a dating, escort, transportation, rideshare, taxi, matchmaking, employment, or background-screening service. RETUOR does not arrange, supervise, direct, inspect, endorse, verify, or guarantee any meeting, ride, user, identity, age, license, endorsement, registration, insurance, motorcycle, equipment, skill, sobriety, fitness, intent, statement, conduct, route, or destination. Opting in, appearing in a carousel, posting, messaging, offering a ride, or requesting a ride creates no obligation, agency, partnership, warranty, or duty between a user and the Released Parties. All communications, meetings, transportation, passenger arrangements, and other interactions occur independently between users and at their sole choice and risk. You are solely responsible for verifying another user and all legal and safety requirements; deciding whether, when, where, and with whom to communicate, meet, ride, or share personal information; meeting initially in a safe public place; telling a trusted person your plans; using lawful protective equipment; and ending or declining any interaction that feels unsafe or inappropriate. Every interaction must be voluntary, respectful, appropriate, and consensual. Backpackers may not be used for harassment, stalking, coercion, discrimination, sexual demands or expectations, exploitation, payment for unlawful services, trafficking, impaired or reckless operation, or any illegal, dangerous, deceptive, or unwanted conduct. Consent may be withheld or withdrawn at any time, and an offer or request never creates an entitlement to a ride or any other interaction. To the maximum extent permitted by law, the Released Parties are not responsible for user screening, disputes, communications, meetings, transportation, crimes, misconduct, accidents, injuries, death, property damage, or any other act, omission, loss, or interaction arising from or related to Backpackers or people encountered through it. Report inappropriate accounts or content through available reporting tools, block unwanted contact, and contact emergency services or law enforcement directly when necessary. RETUOR may remove content, restrict Backpackers access, or suspend accounts, but does not undertake a duty to monitor every interaction or prevent harm.

10. User content and permissions

You retain ownership of content you submit. You grant the Released Parties a worldwide, nonexclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify for formatting, display, distribute, and otherwise use that content as needed to operate, secure, promote, and improve the Service, subject to your visibility choices and the Privacy Policy. You represent that you have all necessary rights and permissions and that your content is accurate, lawful, and does not violate privacy, publicity, intellectual-property, contractual, or other rights. We may remove or restrict content at our discretion but are not required to monitor all content.

11. Prohibited conduct

You may not misuse the Service; access another account; scrape or harvest data; introduce malware; interfere with security or operation; reverse engineer except where law permits; exploit bugs; manipulate points, achievements, games, payments, location, or timing records; submit false reports; stalk, threaten, discriminate against, or harass others; publish private information without permission; infringe rights; spam; conduct unauthorized commercial activity; or use the Service in a way that creates risk, liability, or harm.

12. Purchases, subscriptions, and third-party services

Paid features may be subject to additional purchase terms, app-store rules, renewal terms, taxes, and refund policies shown at purchase. Third-party maps, routing, weather, hosting, storage, payment, messaging, app stores, websites, and other services have their own terms and privacy practices. We do not control and are not responsible for third-party services, availability, content, security, accuracy, decisions, or acts. Links and integrations do not imply endorsement.

13. Emergency limitations

RETUOR is not an emergency communications or rescue service and is not designed or guaranteed to contact police, fire, medical, roadside, marine, towing, search-and-rescue, or other assistance. Location sharing and notifications may fail or be delayed. In an emergency, contact the appropriate emergency service directly and use available official safety resources.

14. Intellectual property and limited license

The Service, excluding user content, and its software, design, branding, logos, databases, and other materials are owned by or licensed to the Released Parties and protected by law. Subject to these Terms, you receive a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for its intended purposes. No ownership rights are transferred.

15. Service changes, moderation, suspension, and termination

We may add, change, suspend, restrict, or discontinue any part of the Service; correct records; remove content; limit features; or suspend or terminate accounts when reasonably necessary for operation, safety, security, legal compliance, enforcement, or business reasons. Features and data may not always be available. You may stop using the Service at any time and may request account deletion through available controls, subject to lawful retention.

16. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, AVAILABILITY, SAFETY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, TITLE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL PREVENT HARM. NO ORAL OR WRITTEN INFORMATION CREATES A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

17. Limitation and release of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND AGREE NOT TO HOLD THE RELEASED PARTIES RESPONSIBLE FOR THE ACTS OR OMISSIONS OF ANY USER OR THIRD PARTY; ANY ACCIDENT, INJURY, DEATH, LOSS, DAMAGE, DISPUTE, CRIME, OR ILLEGAL ACTIVITY; ANY ROAD, TRAIL, WATER, TRAFFIC, WEATHER, TERRAIN, VEHICLE, MECHANICAL, ENVIRONMENTAL, OR OTHER CONDITION; OR YOUR RELIANCE ON OR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES; PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM USER OR THIRD-PARTY CONDUCT OR INHERENT ACTIVITY RISKS; OR AMOUNTS EXCEEDING THE GREATER OF THE AMOUNT YOU PAID TO RETUOR DURING THE TWELVE MONTHS BEFORE THE CLAIM OR US$100. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.

18. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Released Parties from claims, demands, proceedings, damages, judgments, losses, liabilities, penalties, fines, costs, and reasonable legal fees arising from or related to your use of the Service; your activity, vehicle, route, ride, event, club, game, meetup, content, or transaction; your violation of law or these Terms; or your infringement of another person’s rights. This obligation does not apply where prohibited by law.

19. Disputes and governing law

Before filing a claim, you agree to contact us and attempt in good faith to resolve the dispute informally. These Terms are governed by the laws that apply where Mackes Software is legally established, without regard to conflict-of-law rules, except that mandatory consumer protections and jurisdiction rules remain applicable. Any dispute must be brought in a court of competent jurisdiction unless the parties separately agree to another lawful process. This section does not prevent either party from seeking urgent injunctive relief or using a qualifying small-claims process.

20. Changes to these Terms

We may update these Terms to reflect changes in the Service, law, safety practices, or business operations. We will provide notice when required. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law. If you do not agree to an update, stop using the Service.

21. General terms

If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a reorganization, financing, sale, or transfer of the Service. These Terms, the Privacy Policy, purchase terms, and any feature-specific rules form the entire agreement concerning the Service. Headings are for convenience only. Provisions that by their nature should survive termination will survive.
